To participate on any Christmas Lights Community website, you must register as a member. This registration is free of charge. By registering, you agree to abide by the following Terms and Conditions:

Christmas Lights Community is built on the principal of real people helping other people. To achieve that goal when you register, you must provide your full legal name (first name and last name,) and your physical location, specifically your street address, City and State of residence, and a working phone number in order to be approved.

After you provide your full legal name, only a Christmas Lights Community administrator is permitted to make changes to your name as it exists in your user profile. You are required to immediately notify Christmas Lights Community if your name changes or is otherwise incorrect at any time.You must also choose a unique user name or “handle” during the registration process, as well as a unique and valid email address. Duplicate user names and email addresses are not allowed, so if the name or address you enter is already in use, you will be prompted to choose another one. After you choose a unique user name and complete the registration process, only a Christmas Lights Community administrator is permitted to make changes to your user name as it exists in your user profile.To prevent any member from using another’s user name, each member’s account is password protected with email verification. No member is permitted to share his or her account with any other person. When you register, an email message will be dispatched to the email address you provided for the purpose of activating your account. You must follow the directions contained in that email message in order to activate your account. You may also change the email address in your profile. HOWEVER, doing so will require you to confirm that your email address is valid, by repeating the email activation procedure. In the event that you are unable to confirm that your email address is valid, your account may be manually activated by a Christmas Lights Community administrator.

Christmas Lights Community, at its own discretion, may bar registration from any specific email service or ISP, and reserves the right, in its sole discretion, to terminate the access of any user, without notice.

Any message posted on our Forums or web site (herein referred to as “THE SITE”) expresses only the views of the author of the message and does not necessarily reflect the views of THE SITE or any person or entity associated with them. All comments and materials submitted to THE SITE shall be considered non-confidential and the property of Christmas Lights Community, unless otherwise agreed to, in advance, and in writing by Christmas Lights Community. THE SITE uses moderators and administrators to monitor the content and appearance of messages posted on THE SITE. However, considering the real-time nature of this bulletin board, it is impossible for us to monitor or review every message. Therefore, you agree that neither THE SITE, nor any person or entity associated with them, will be held responsible for the contents, accuracy, completeness or validity of any information posted in them.

Further, you acknowledge that the administrators of THE SITE have the capability, under strict and narrowly defined parameters (a user request; evidence or suspicion of a crime that has been committed or is in progress [i.e. child pornography]; request or demand of law enforcement personnel; numerous complaints by others that a user has been abusing the Private Message (”PM”) system [i.e. spamming] or administration suspects the account of being a duplicate account for a banned or otherwise prohibited user) to access or be compelled to access a member’s PM(s). You hereby acknowledge that you have read this statement and are aware of this capability and that the possibility exists that it may be used in conformity with the parameters as outlined herein; subject, however to Christmas Lights Community’s reservation of the right to revise, modify, or change the aforementioned parameters, if warranted, as situations or circumstances may arise that are impossible of future ascertainment. Additionally, be advised that it is NOT THE POLICY OF THE ADMINISTRATORS OF THIS SITE TO READ OR ACCESS PM(S) IN THE ORDINARY, ROUTINE, AND/OR NORMAL COURSE OF THE SITE’S ADMINISTRATION AND MAY ONLY BE USED UNDER THE CIRCUMSTANCES AS OUTLINED ABOVE; that no form of encoding is used, and that all steps necessary and proper to insure the privacy of each of our members’ PM(s) will be zealously safeguarded.

You agree that you will not use THE SITE to post any material, or links to any material, which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person’s privacy, or otherwise violate any law. Additionally, you further agree not to disrupt, modify or interfere with the Website or its associated software, hardware and servers in any way, and you agree not to impede or interfere with others’ use of the Website and shall not alter or tamper with any information or materials on, or associated with this Website.

You agree that you will not post any copyrighted material without the express permission of the copyright holder, unless such copyright is owned by you. Advertisements, chain letters, pyramid schemes, and solicitations are also inappropriate on these Forums, unless otherwise agreed, in advance, in writing by Christmas Lights Community. Also, you may not modify any of the materials found on THE SITE, nor attempt to pass off any of the materials found therein as your own.

We have the ability to edit and/or remove objectionable messages from THE SITE. Any user who believes that a posted message is objectionable is encouraged to contact us immediately “Report Post” feature of the web site. Upon receipt of such notification, we will make every effort to take such action as we deem necessary within a reasonable period of time. Since this is a manual process, you are advised that we may not be able to remove or edit particular messages immediately.

THE SITE has the option to monitor at any time all conversations, including Private Messages which are posted in the “Flashchat” section of the forums. These conversations are logged, and reviewed for any material, or links to any material, which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person’s privacy, or otherwise violative of any law.

Christmas Lights Community reserves the right to edit or delete any message, from any forum, for any reason whatsoever, at our sole discretion. You agree that you are solely responsible for the content of your messages, and that you will indemnify and hold harmless Christmas Lights Community, THE SITE, Jelsoft Enterprises Ltd. (the developers of vBulletin, which is a software package used by Christmas Lights Community) and their agents and employees with respect to any claim based upon the appearance and/or transmission of your message(s).You agree that we are all amateurs, and as such may from time to time supply incorrect information. While every effort is made to provide correct information, mistakes happen. Therefore, you agree that you will verify any and all information before using it in any residential or commercial display.As an amateur, volunteer organization, things may not move as quickly as you would like. It may take 24 hours or more for your registration to be approved. You agree that the organization operates at its own pace.

You agree that information from this site may not be re-posted to any online forum, message board, chat room, web site, email or any other method not covered in these Terms of Service, without the permission of the original posting member. It is not the intention that such information be kept confidential or the use of the information limited; however, it is meant to enable other members to speak openly and honestly to all members without fear of potential liability from a post attributed to a member being posted on another site without permission.

Unless disclosure is required by law or a court of competent jurisdiction, your identity and any other information THE SITE may know about you will not be released.

THE SITE is owned and operated by Synchronized Christmas, Inc. All matters relating to THE SITE and your access and use of the same, shall be governed by and interpreted under the laws of the state of Texas. Additionally, by using this site you are contracting for Texas law to be applied under any conflict of laws analysis. Any action brought in connection with THE SITE and your access and use of same shall be filed within the appropriate statute of limitations under Texas law. Any legal action or proceeding relating to these Terms and Conditions, or your access to THE SITE shall be instituted in a state or federal court in Smith County, Texas. You and Synchronized Christmas, Inc. agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding. Christmas Lights Community reserves the right, at its sole and absolute discretion, to make changes in these Terms and Conditions at any time without notice. Your continued use of THE SITE or any of the Site’s features after any such changes signifies your acceptance of the Terms and Conditions as revised. No delay or omission by Christmas Lights Community to exercise any right occurring upon any noncompliance on your part with respect to any of these Terms shall impair any such right or power or be construed to be a waiver thereof. Any waiver by Christmas Lights Community of any of the covenants, conditions, or agreements to be performed by you shall not be construed to be a waiver of any succeeding breach thereof or of any covenant, condition, or agreement herein contained.

These terms and conditions apply while you are accessing the Website and remain in effect indefinitely thereafter, and shall survive the termination or expiration of any relationship between you and Christmas Lights Community.

Each of the terms and limitations provided by these Terms, including referenced terms and policies, are important to Christmas Lights Community. In the event any provision contained herein, including referenced terms and policies, is held by a tribunal of competent jurisdiction to be contrary to the law, the remaining provisions herein will remain in full force and effect, to the maximum extent possible.
